Welcome to Dagment.com, a service provided by Dagment Corporation, a Delaware-registered company ("Dagment", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, APIs, tools, and datasets (collectively, the “Service”).

By accessing or using the Service, you ("User", "you", or "your") agree to be legally bound by these Terms. If you do not agree, do not access or use the Service.

1. Eligibility

Dagment provides access to a data intelligence platform offering:

  • Business, Personal, Property, Contact and Other Data
  • Sales Prospecting & Lead Generation Tools
  • Data Enrichment and Cleansing
  • Competitive and Market Intelligence
  • Custom Research and Investigative Capabilities

Our data is aggregated, matched, and structured from public, licensed, and proprietary data sources.

3. Permitted Uses

You may use the Service for:

  • Business purposes (e.g., B2B outreach, analytics, compliance, research);
  • Personal or consumer purposes (e.g., self-research, due diligence, academic or journalistic investigations);
  • Non-commercial or educational uses, provided usage complies with all laws and these Terms.

You are solely responsible for determining whether your use is legally permissible and for obtaining any required consents, permissions, or licenses related to such use.

4. Prohibited Uses

You may not:

  • Use the Service for unlawful surveillance, harassment, stalking, or identity theft;
  • Resell, sublicense, or redistribute any part of the Service or data without written permission;
  • Use data for credit, insurance, housing, or employment decisions in violation of the Fair Credit Reporting Act (FCRA);

5. Account Registration & Security

  • Promptly notify us of unauthorized access or suspected breaches.

You are responsible for all activities that occur under your account, whether authorized or not.

6. Data Accuracy and Use Limitations

While Dagment strives to provide reliable and current data, we do not guarantee its accuracy, completeness, or fitness for any particular purpose.

You acknowledge and agree:

  • Data may contain errors, be outdated, or originate from third-party sources we do not control;
  • You are solely responsible for verifying data before acting on it;
  • You will not hold Dagment Corporation or its officers, directors, employees, or affiliates liable for your use of the data.

7. Data Compliance and Legal Use

You agree to comply with all relevant U.S. federal, state, and local laws, including but not limited to:

  • The Fair Credit Reporting Act (FCRA)
  • Gramm-Leach-Bliley Act (GLBA)
  • California Consumer Privacy Act (CCPA)
  • General Data Protection Regulation (GDPR), if applicable
  • CAN-SPAM Act and similar marketing compliance laws

Dagment does not serve as a Consumer Reporting Agency (CRA) and prohibits use of its data in connection with creditworthiness, tenant screening, or employment decisions.

8. Intellectual Property

All content, software, data models, user interfaces, databases, tools, and documentation are the intellectual property of Dagment Corporation or its licensors.

You may not copy, modify, distribute, reverse engineer, or create derivative works from our platform or datasets, except as permitted under your license.

9. Subscriptions, Billing & Taxes

Access to certain features or datasets may require a paid subscription. Subscription terms include:

  • Automatic renewal unless cancelled in accordance with plan terms;
  • Non-refundable fees, unless explicitly stated otherwise;
  • Dagment reserves the right to change pricing and features at renewal with advance notice.

All applicable sales, use, and value-added taxes are your responsibility unless otherwise stated.

10. Suspension and Termination of Access

Dagment reserves the right to suspend or terminate your account or access to the Service at any time and for any reason, including but not limited to:

  • Breach of these Terms;
  • Suspected misuse of data or illegal activity;
  • Excessive API usage, abuse of free tiers, or activities affecting platform performance;
  • Use of false or misleading identity or billing details;
  • Failure to pay applicable fees;
  • Requests by law enforcement or government authorities.

We may also restrict certain features, limit access to specific datasets, or place accounts under review without notice.

11. Confidentiality and Data Protection

Both parties agree to maintain confidentiality of any non-public or proprietary information disclosed through the platform. This includes internal data structures, technical infrastructure, custom data feeds, and business practices.

We implement reasonable technical and organizational safeguards to protect data, but you acknowledge that no platform can guarantee absolute security.

12. Disclaimers and No Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, either express or implied, including:

  • Fitness for a particular purpose;
  • Non-infringement;
  • Accuracy or completeness of data;
  • Uptime or error-free performance.

Use of the Service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Dagment Corporation, its officers, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, or consequential damages;
  • Loss of profits, revenue, data, or goodwill;
  • Any damages arising out of use or inability to use the Service or reliance on its data;
  • Any liability exceeding the amount you paid in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Dagment Corporation, its owners, directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use or misuse of the Service or data;
  • Your violation of these Terms or any applicable law;

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use of the Service after changes are posted constitutes your agreement to the updated Terms.

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

You agree that any disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
